IT Expert Referral Programme’s Policy of GS Services Poland

What is the IT Expert Referral Programme?

Under the IT Expert Referral Programme (the "Programme") we give to you bonuses, if you refer IT Experts to us and we decide to hire them. This Policy sets forth the conditions, which you must meet to receive a bonus. If you know an IT Expert who may fit a job description that we published, please take a few minutes to read this Policy.

What are the bonuses and when do we pay them?

You will receive a bonus depending on the work experience of the IT Expert who you referred to us.

We will inform you via e-mail, if the IT Expert who you referred gets hired (first bonus) and completes 90 days of employment (second bonus).

If the same IT Expert is referred by multiple participants, the first that sends us a referral of the IT Expert via our contact form gets a bonus. For avoidance of doubt, we will note the specific time at which a referral sent via contact form has been delivered to us.

Which referrals we reward?

We reward only successful referrals. Therefore, you receive bonuses, only if the IT Expert who you referred gets hired (first bonus) and completes 90 days of employment / providing services (second bonus).

You do not receive any bonuses, if IT Expert who you referred does not fit for a job offer or we did not decided to hire her or him. However, you are still eligible for rewards if the IT Expert gets hired for another position at a later time (but not later than 6 months after submitting referral).

Additionally, we do not reward the following referrals:

  • submitted after we received the CV, which was sent to us directly by the IT Expert;
  • if we already have the IT Expert’s CV in our database and we can legally process it for purposes of pending or future recruitment;
  • made with help of any recruitment agencies or made by such agencies or persons and entities that provide professional recruitment services;
  • submitted not in conformity with the section “How to submit a referral”.

Who can participate?

Every natural person can participate in the Programme. The only condition is that you must be at least 18 years or older and have full legal capacity. The Programme is not limited to our employees or associates. However, you cannot participate in the Programme, if you are our recruiter (regardless if you work for us as an employee, an associate or a service provider).

Who can be referred?

The referred IT Expert must have at least 3 years documented work experience in a job covering a similar technology area to a job offer that we published. We assess the work experience as of the day of receiving the IT Expert’s CV. We consider only those IT Experts, who fit the job description and who did not participate in our recruitments within the past 12 months before you submitted a referral.

You cannot refer yourself. You always have to recommend another person.

You can refer different IT Experts as many time as you wish.

How to submit a referral?

To submit a referral effectively, please refer the IT Expert to us via contact form at www.gsservices.pl. We do not take into account referrals sent in any other way.

Before you send us a referral, you must receive from the IT Expert the following consents:

  • I agree to receive from GS Services sp. z o.o. with its registered office in Warsaw, Poland invitation to the “IT Expert Referral Programme” via e-mail or phone;
  • I agree to the processing of my personal data including my name (names), surname, e-mail address and phone number by GS Services sp. z o.o. with its registered office in Warsaw, Poland, for the purposes of inviting me to the “IT Expert Referral Programme”;
  • I have read the section “How we process the IT Expert’s personal data” of the IT Expert Referral Programme’s Policy of GS Services Poland and I am informed that (i) my personal data are processed by GS Services sp. z o.o. with its registered office in Warsaw, Poland, in order to invite me to the “IT Expert Referral Programme”, (ii) I have a right to withdraw my consents at any time by sending an e-mail to the following e-mail address of GS Services sp. z o.o.: hello@gsservices.pl, (iii) other conditions of processing my personal data are included in the section “How we process the IT Expert’s personal data”, a part of the IT Expert Referral Programme’s Policy of GS Services Poland, available at: www.gsservices.pl/recommend-policy.

Additionally, by submitting a referral you note and agree to the following rules:

  • you are submitting a referral in response to our job offer;
  • by submitting a referral, you agree to the conditions of this Policy;
  • the submission of a referral does not guarantee that we will hire the recommended IT Expert. We do not even guarantee inviting such IT Expert to a job interview. Every recommended IT Expert will go through our standard recruitment process but in all cases we reserve the right to not to review the IT experts CV in detail or at all;
  • a referral must meet all conditions set forth in this Policy, in particular all required consents of the IT Expert must be provided;
  • you warrant that the IT Expert has expressed all above consents personally and voluntarily;
  • the IT Expert who you referred to us can withdraw from the Programme at every stage of a recruitment process. The withdrawal of the IT Expert from the Programme also means that your referral of the IT Expert has been withdrawn.

How we process your personal data?

We process your personal data in conformity with the General data processing regulation (the “GDPR”). We are the controller of your personal data relating to your participation in the Programme. In all matters regarding processing of your personal data you may contact us by e-mail: hello@gsservices.pl.

Purposes and legal basis of personal data processing

We will process your personal data in order to:

  • enable you to participate in the Programme and to conduct the Programme in accordance with this Policy (in particular, to communicate with you and to inform you about the rules of the Programme) – in this respect the processing is based on your consent (i.e. pursuant to article 6.1(a) of the GDPR);
  • if your referral is rewarded by us under the conditions of this Policy – execute a contract concluded with you in the document form in the meaning of art. 77(2) of the Polish Civil Code on the basis of this Policy (in particular to pay you the bonuses provided under the Policy and to perform our statutory tax duties) – in this respect the processing is based on the performance of a contract to which you are a party (i.e. pursuant to article 6.1(b) of the GDPR);
  • defend against your potential claims related to the Programme – in this respect the processing is based on our legitimate interests (i.e. pursuant to article 6.1.(f) of the GDPR).

Your personal data will not be subject to automated decision-making nor profiling.

Provision of personal data by you is voluntary. However, to participate in the Programme and receive a bonus it is necessary for you to provide us with the following data: name (names) and surname, contact information, payment information (if your referral is rewarded by us under the conditions of this Policy).

Data recipients and data transfer to third countries

The recipients of your personal data will be our authorized staff and cloud hosting providers. Your personal data will not be transferred to third countries (outside European Economic Area) nor to international organizations.

Period of data storage

We plan to store your personal data for a period of your participation in the Programme and for the limitation period of your potential claims against us stemming from your participation in the Programme.

Your rights under the GDPR

You have the following rights in connection to the processing of your personal data:

  • the right to withdraw consent to the processing of personal data – this can be done at any time, however, it will not affect the lawfulness of processing based on consent before its withdrawal;
  • the right to object, on grounds relating to your particular situation, at any time to processing of your personal data which is based on our legitimate interests;
  • the right to obtain from us information on the processing of your personal data and to request a copy of that data (so-call “right of access”). The first copy of personal data is free of charge;
  • the right to rectify inaccurate or incomplete personal data;
  • the right to erasure, which may be used when you have withdrawn your consent to the processing, or when the personal data are no longer necessary for the purposes for which they were collected or otherwise processed, or the personal data have been unlawfully processed; or the personal data have to be erased for compliance with our legal obligation;
  • if you find that the processing of your personal data is inaccurate, unlawful, or that we no longer need the personal data for the purposes of the processing, you have the right to require that we restrict the processing;
  • the right to file a complaint at the President of the Personal Data Protection Office, if you find that the processing of personal data by us violated the GDPR or other relevant provisions of law.

How we process the IT Expert’s personal data?

We process the IT Expert’s personal data in conformity with the General data processing regulation (the "GDPR"). We are the controller of personal data of the IT Expert. In all matters regarding processing of personal data the IT Expert may contact us by e-mail: hello@gsservices.pl.

Purposes and legal basis of personal data processing

We will process the IT Expert’s personal data in order to:

  • invite the IT Expert to the “IT Expert Referral Programme” – in this regard the processing is based on the IT Expert’s consent (i.e. pursuant to article 6.1(a) GDPR);
  • enable the IT Expert to participate in the current job application process – in this regard the processing is based on the IT Expert’s consent (i.e. pursuant to article 6.1(a) GDPR);
  • enable the IT Expert to participate in our future job application processes, provided that the IT Expert gave her/his consent to that end (i.e. pursuant to article 6.1(a) GDPR).

The IT Expert’s personal data will not be subject to automated decision-making nor profiling.

Provision of personal data by the IT Expert is voluntary. However, (i) to invite the IT Expert to the “IT Expert Referral Programme” it is necessary to provide us with the following data: name (names), surname, contact information, (ii) to participate in job application process it is necessary for the IT Expert to provide us with the following data: name (names) and surname, contact information, education, professional qualifications and employment background.

Data source

We received the IT Expert’s personal data including her/his name (names), surname, e-mail address and phone number from you (i.e. the participant of the Programme) for the purposes of inviting the IT Expert to the Programme.

Data recipients and data transfer to third countries

The recipients of the IT Expert’s personal data will be entities for whom we organize job application processes, as well as our authorized staff, recruiters, cloud hosting providers and recruitment services companies with whom we cooperate. The IT Expert’s personal data will not be transferred to third countries (outside European Economic Area) nor to international organizations.

Period of data storage

We plan to store the IT Expert’s personal data until the relevant job application process is finished, unless the IT Expert first withdraws consent to the processing. In cases where the IT Expert gave consent to the processing of personal data for the purposes of future job application processes, the data will be stored until the consent is withdrawn.

The IT Expert’s rights pursuant to the GDPR

The IT Expert has the following rights in connection to the processing of her/his personal data:

  • the right to withdraw consent to the processing of personal data – this can be done at any time, however, it will not affect the lawfulness of processing based on consent before its withdrawal;
  • the right to object, on grounds relating to her/his particular situation, at any time to processing of his/her personal data which is based on our legitimate interests;
  • the right to obtain from us information on the processing of the IT Expert’s personal data and to request a copy of that data (so-call “right of access”). The first copy of personal data is free of charge;
  • the right to rectify inaccurate or incomplete personal data;
  • the right to erasure, which may be used when the IT Expert has withdrawn her/his consent to the processing, or when the personal data are no longer necessary for the purposes for which they were collected or otherwise processed, or the personal data have been unlawfully processed; or the personal data have to be erased for compliance with our legal obligation;
  • if the IT Expert finds that the processing of her/his personal data is inaccurate, unlawful, or that we no longer need the personal data for the purposes of the processing, the IT Expert has the right to require that we restrict the processing;
  • the right to file a complaint at the President of the Personal Data Protection Office, if the IT Expert finds that the processing of personal data by us violated the GDPR or other relevant provisions of law.

What else you should know?

Bonuses paid under the Programme are subject to taxation. If you do not conduct a business activity, we will pay you bonusses on the basis of a bill that you issued in conformity with this Policy. We will also send you and your tax office an appropriate tax information within the required period and in accordance with the applicable Polish tax law. If you conduct a business activity, we will pay you bonusses on the basis of an invoice that you issued in conformity with this Policy.

The Programme is effective from 01.08.2021. The Programme may be terminated at any time. However, if you submitted a referral before the Programme was terminated, you retain a right to receive a bonus provided that other conditions set forth in this Policy are met.

Any mention of:

  • "IT Expert" means a candidate whose referral you submitted under this Policy and who meets all of the conditions of this Policy,
  • "you" means a participant of the Programme, who meets all of the conditions of this Policy,
  • "we" means the organiser of the Programme, i.e. GS Services spółka z ograniczoną odpowiedzialnością with its registered office in Warsaw, Poland at Koprzywiańska Street 20, 02-285 Warsaw, entered into the Register of Entrepreneurs of the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register under the Company Registration Number: 0000617457, Tax Identification Number: 1132910107, with share capital PLN 5 000 fully paid up.
